1. TERMS AND CONDITIONS.

1.1 These Terms and Conditions apply to all orders and. Receipt of acknowledgement of order by you, constitutes your acceptance that our conditions are the only conditions that apply to the contract, unless otherwise agreed by ourselves in writing prior to the relevant order.

2. PAYMENT TERMS.
2.1. PRE PAYMENT.

2.1.1. You must make payment at the point of order, and we will not start any work until we receive and clear the full payment.

2.2. VAT.

2.2.1. If, after payment, you realize there has been an error in the amount of VAT charged or if artwork means the product is taxable, you as the customer are responsible for paying any excess VAT in full.

3. PASSING OF TITLE AND RISK.

3.1. The risk in the goods shall pass to you on delivery.

3.2. We will retain ownership of all goods, whether delivered or not, until we receive full payment.

4. ARTWORK.

4.1. It is the responsibility of all artwork creators to comply with artwork guidelines, and we will not hold them liable for failure to comply with these guidelines.

4.2. Liability for all content and errors in the original artwork remains the customer’s responsibility.

4.3. By uploading artwork, you the customer confirm you have the rights to use all copyrighted material within, and that none of the content is illegal.

5. PRODUCTS.

5.1. We may change any details of the advertised products without notice, and although we make every effort to describe the goods accurately in the advertisement, we do not provide any warranty regarding accuracy and we do not accept responsibility for errors in description and any resulting loss.

6. QUOTATIONS AND CONTRACTS.

6.1. We reserve the right to adjust prices quoted, subject to any changes in the law or government regulations that require us to increase prices through direct taxation, import duties, customs and excise duties, or any other means. The prices are based on today′s current costs of production and in the event of any increase in wages or costs of materials to us occurring after the confirmation of an accepted contract; we shall be entitled to charge such increases to you. Where applicable, all prices quoted are subject to VAT at the current rate.

7. DELIVERY.

7.1. All deliveries are subject to our delivery policy.

8. QUANTITY VARIATION.

8.1. Delivery of a quantity shall deem us to have fulfilled our contract within 5% plus or minus of the quantity of printed goods ordered.

9. COMPLAINTS & CLAIMS.

9.1. You must make complaints within 48 hours of receiving your goods. Any complaints made after this time period are void of any right to refund or reprint.

9.2. You must make claims arising from damages, delay, or partial loss in transit in writing to us, and they must reach us within 48 hours of delivery.

9.3. You must make all claims regarding the quality or quantity of the goods in writing to us within 48 hours of receiving the goods, or else the goods will be considered to meet the quality and quantity requirements of the contract.

9.4. You must examine all goods delivered at the time of delivery. We shall not be liable for any loss arising from damage caused to the goods in transit unless loss or damage is noted on the delivery note at time of delivery.

9.5. Claims in respect of non-delivery must be made in writing so as to reach us within 48 hours from receipt of our invoice.

10. LIABILITY.

10.1. Save in so far as defects in the goods cause death, injury or damage to personal property, our liability for any loss or damage suffered by you in respect of the goods shall be limited to the contract value of the goods.

10.2. We can accept no responsibility for loss or damage arising from the supply of goods under this contract unless you have fully complied with the notification of claims procedure set out in clause 9.

10.3. Nothing in these terms and conditions shall affect the rights of a consumer.

11. CANCELLATION CHARGES.

11.1. Cancellation of job will be charged at 100% of the value of the job. No refund will be available for cancellation.

12. FORCE MAJEURE.

12.1. We will not be held responsible for failure or delay in the carrying out of our obligations under the contract arising from any cause outside our reasonable control or by inability to procure materials or articles except at higher prices due to any such cause and in such circumstances we shall be entitled by notice to terminate the contract in whole or in part without incurring any liability whatsoever to you.

13. SEVERABILITY CLAUSE.

13.1. No secondary oral agreements exist. Any amendments to these terms must be in writing in order to be valid. This applies also to the abrogation and the amendment of this written form requirement.

13.2. If any provision of these terms is, for any reason, invalid and/or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law. The parties agree to replace an invalid and/or unenforceable provision with a valid and/or enforceable provision which most closely approximates the intent and economic effect of the invalid and/or unenforceable provision.

14. WAIVER.

14.1. Delay in exercising, or failure to exercise, any right or remedy in connection with these terms and conditions shall not operate as a waiver of that right or remedy. The waiver of a right to require compliance with any provision of these terms and conditions in any instance shall not operate as a waiver of any further exercise or enforcement of that right and the waiver of any breach shall not operate as a waiver of any subsequent breach. No waiver in connection with these terms and conditions shall, in any event, be effective unless it is in writing, refers expressly to this clause, is duly signed by or on behalf of the person granting it and is communicated to the person in whose favour the waiver is made.

15. MARKETING & SOCIAL MEDIA.

15.1. Unless you are a WHITE LABEL customer, we may use images of your products (both finished and in production) in our marketing materials and on social media.

16. MISCELLANEOUS.

16.1. The contract between the Company and the Customer shall be governed by English Law.
